1. About These Terms

These terms of service govern your use of the 123Tax service. By signing up for or using 123Tax, you agree to be bound by these terms. Please read them carefully. If you do not agree with any part of these terms, you should not use the service.

2. The Service

123Tax provides the following services to self-employed individuals and sole traders in the UK:

  • Digital record keeping of income and expenses
  • Receipt and invoice processing from photos and documents you send us
  • Making Tax Digital (MTD) quarterly submissions to HMRC on your behalf
  • Self Assessment tax return filing

3. What We Don't Do

It is important to understand the limits of the 123Tax service:

  • We are not accountants and do not provide accounting services
  • We are not financial advisors and do not provide tax planning or financial advice
  • We process your records and submit your returns based on the information you provide, but we do not provide tax advice
  • If you need personalised tax advice, we recommend consulting a qualified accountant or tax advisor

4. Your Responsibilities

When using the 123Tax service, you agree to:

  • Provide accurate and complete information about your income and expenses
  • Send us your receipts and invoices promptly so we can keep your records up to date
  • Review and confirm quarterly summaries when we send them to you before submission
  • Pay your tax bill directly to HMRC — 123Tax does not collect or pay taxes on your behalf
  • Respond to our messages in a timely manner, especially around submission deadlines

5. Subscriptions & Billing

  • 123Tax is a monthly subscription service
  • All prices shown are exclusive of VAT
  • Your subscription is billed on the same date each month, starting from your sign-up date
  • You can cancel at any time with no exit fees or cancellation charges
  • We may update our pricing from time to time and will give you reasonable notice of any changes

6. Cancellation

  • You can cancel your subscription at any time by contacting us via WhatsApp or email
  • Your service will continue until the end of your current paid period
  • After cancellation, we will retain your tax records for 6 years as required by HMRC regulations
  • There are no exit fees or penalties for cancelling

7. Limitation of Liability

To the fullest extent permitted by law:

  • 123Tax provides the service on an “as is” basis and makes no warranties regarding the completeness or accuracy of tax calculations based on the information you provide
  • We are not liable for HMRC penalties that arise because you failed to provide information on time, failed to respond to our confirmation requests, or provided inaccurate information
  • Our total liability to you for any claim arising from the service is limited to the amount you have paid us in subscription fees in the 12 months preceding the claim
  • We are not liable for any indirect, incidental or consequential losses

8. Changes to These Terms

We may update these terms from time to time. If we make significant changes, we will notify you by email or WhatsApp message. Your continued use of the service after any changes take effect constitutes your acceptance of the updated terms.

9. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the use of the 123Tax service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
